To the worshipful justice of Essex County, suiting in Chancery

Humbly complaineth sheweth to your worship: Your orator and oratrix John Bomar and Barbrey his wife one of the daughters of Bibby Bush late of this county deceased. That whereas the said Bibby Bush was in his lifetime and at the time of his death possessed and interested in a considerable estate real and personal consisting in Negro slaves, household goods, stocks of cattle, hoggs and sheep and also several other things of great value amounting to one hundred and fifty four pounds, fourteen shillings and two pence curt. (current) money, and departed this life some time in the year of our Lord one thousand seven hundred and forty eight, INTESTATE, leaving SUSANNA HIS WIDOW, who is sometime since the death of the sd. Bibby intermarried with one Stephen Neal of this county AND ALSO LEFT ISSUE THREE CHILDREN, THOMAS BUSH his oldest, son and heir at law and two daughters named BETSEY BUSH and BARBREY who ye orator intermarried with not soon after the death of the sd. Bibby Bush.

The sd. WID. SUSANNA took out letters of administration on the said Bibby Bush estate and possessed herself of all and singular the said estate and had the same in curt. (Current) money as will more fully and at large appear by the inventory and appraisal returned to this worshipful court now remaining of record which appraisal did amount to upward of one hundred and fifty pounds curt.(current) money, part of which sum of money (that is to day) one hundred and fifty pounds was the appraised value of the Negro slaves in the inventory mentioned and by virtue of the sd. Stephen Neal’s marriage with the sd. Susanna he became possessed of the sd. Negroes and other estate of the sd. Bibby Bush dec. and paid to ye orator and oratrix her part of the personal estate as mentioned in the inventory aforesd. But ye worships having lately apointed one Thomas Henry Brooks of this county guardian to the sd. Tho. Bush, son and heir of the sd. Bibby Bush dec. who took possession of all and singular the said four Negro slaves and refused to deliver or pay to ye orator and oratrix one third part of the appraised value of the said Negro slaves after the widow’s dower as third part should be first set apart and for that purpose ye complaints did apply in assuredly manner often times to the sd. Thomas Henry Brooks and demanded her share of her father’s estate in the sd. Slaves who absolutely refused to do.. In tender consideration whereof and for as much as ye orator and oratrix is remedless save in this worship court where matters of this sort are relieveable and for as much as ye orator and (oratrix)

cannot at common law commence an action to recover the same with interest thereon, but is only and properly relieveable in a court of equity. To the end therefore that the sd. Thomas Henry Brooks, guardian as aforesaid and others, the confederates, may be compelled to make true perfect answer on their corporal oath to all and singular the principles in this bill mentioned and more particular set forth and discover how many Negro slaves the said Bibby Bush died possessed of and inventoried, how much were they appraised to as the estate of the sd. Bibby Bush, is not this the sd. Tho. Henry Brooks guardian to the (said) Tho. Bush son of the sd. Bibby Bush, is not Barbrey the wife of the complaint and daughter of the said Bibby, had he not any other daughter, is she alive whether the sd. Defendant have paid the complainant their due share of her father’s estate or appraised value of the Negroes and why he doth not pay to the complaint the sd. Appraised value of the said slaves, and that ye worship will make such order or decree in the premises as to you shall seem fitting and agreeable to equity and good conscience.
